1. Objective

This document sets out the pre-contractual information for distance contracts on the website www.mgnm.ptpursuant to Article 4 of Decree-Law no. 24/2014of February 14, as well as all associated subdomains and sub-websites.

The domain www.mgnm.pt is owned by M. Guimarães Novais & Maia, Lda, with registered office at Rua do Almada, 248, legal person no. 501057943, registered at the Commercial Registry Office of Porto – 2nd Section, with share capital of 100.000.00, which is dedicated to the wholesale and retail trade of hardware and tools, construction materials and equipment, DIY, decoration, garden, cleaning and hygiene articles, toys, costume jewelry, textile and home textile products, clothing and footwear, kitchen utensils and drugstores, among others.

M. Guimarães Novais & Maia, Lda reserves the right to freely modify this pre-contractual information in order to adapt it to the applicable legislation, without the need for prior notice, safeguarding contracts already signed and in progress.

Browsing the website, as well as purchasing any product through it, implies acceptance of these conditions.

2. Conditions of use of the site

The User undertakes to use this website in accordance with the applicable legislation, refraining from using it for illegal activities, contrary to morality and good customs or harmful to the rights and interests of third parties.

The website may contain links to third-party websites which may provide useful information or tools. These terms and conditions do not apply to those websites, so the User should consult their respective policies.

3. Change in conditions

M. Guimarães Novais & Maia, Lda reserves the right to modify, unilaterally and at any time, without prior notice, the presentation and content of the website, its services and these conditions, without prejudice to contracts already entered into.

These conditions are governed by Portuguese law.

In the event of a dispute, the courts in the area of the company’s registered office shall have jurisdiction, without prejudice to the mandatory rules applicable to the consumer, in particular those of their country of residence.

10. Product description

M. Guimarães Novais & Maia, Lda tries to ensure that product descriptions and images are accurate. However, it does not guarantee that they are error-free.

In the event of non-compliance, the User may exercise their rights under the applicable legal terms, namely under Decree-Law no. 84/2021.

12. Product availability

M. Guimarães Novais & Maia, Lda only processes orders after payment has been confirmed and cannot guarantee the availability of products until then.

Shipping is only carried out on working days.

In the event of a stock shortage, the company may:

a) Contact the customer to inform them of new availability or changes in conditions, and proceed with the order only with their consent
or
b) Cancel the order, with a full refund of the amounts paid

The occurrence of delays in shipment does not entitle you to compensation.
